When Is a Divorce Decree Translation
Required by USCIS?
Before USCIS can approve any immigration petition based on a current marriage, they must verify that any prior marriage was legally terminated. If the prior divorce took place in a foreign country, USCIS requires a certified English translation of that divorce decree — even if the divorce happened years ago.
This applies whether it is the petitioner (U.S. citizen or LPR sponsor) or the beneficiary (the foreign national applying) who was previously married. Both parties must provide documentation of prior marriage termination.
MEJPBS translates and certifies foreign divorce decrees from 170+ languages. Every translation includes the Certificate of Accuracy required by USCIS and is delivered within 48 hours standard.
Divorce decree vs. divorce certificate: The terms are often used interchangeably, and many countries issue a document called a "divorce certificate" rather than a "divorce decree." MEJPBS translates both — the document name does not affect the translation or certification process. If you are unsure what your document is called, email a scan and we will confirm.
I-130 — Spousal Petition
Sponsoring a foreign spouse. If either party has a prior divorce, the decree must be certified. Both the marriage certificate and divorce decree may be needed.
I-485 — Adjustment of Status
Applying for a green card based on marriage. USCIS requires proof that any prior marriage ended legally, via certified divorce decree translation.
K-1 — Fiancé(e) Visa
Entering the U.S. to marry a U.S. citizen. If either party was previously married, the divorce decree must be certified before the K-1 can be approved.
N-400 — Naturalization
Applying for U.S. citizenship. USCIS reviews marital history — prior divorces abroad must be documented with certified decree translation.
Remarriage in the U.S.
Some U.S. states and county clerks require a certified translation of a foreign divorce decree before issuing a new marriage license.
Legal & Estate Proceedings
U.S. courts handling inheritance, property, or family law matters may require certified translation of a foreign divorce decree as evidence.

Divorce Decree Translation FAQ
USCIS requires proof that any prior marriage was legally terminated before approving an immigration petition based on a current marriage. If your prior divorce took place abroad and the decree is in a foreign language, USCIS requires a certified English translation with a Certificate of Accuracy. This applies to both the U.S. citizen petitioner and the foreign national beneficiary if either was previously married.
Divorce decree translations are commonly required for: I-130 (Petition for Alien Relative based on marriage), I-485 (Adjustment of Status), K-1 Fiancé Visa (if either party has a prior marriage), I-751 (Removal of Conditions), and N-400 (Naturalization). The requirement applies whenever a prior marriage must be documented as legally ended.
Yes — USCIS typically requires both. The marriage certificate proves the prior marriage existed. The divorce decree proves the prior marriage legally ended. Both must be certified separately. MEJPBS can translate and certify both documents in one order. Email all documents together and we'll quote the full package.
Handwritten foreign documents are common and MEJPBS translates them regularly. Send the clearest scan or photo you can. If any portion is illegible, we note it accurately in the translation with a bracketed notation — which is the correct professional standard. We never guess or fill in unclear text.
"Divorce decree" and "divorce certificate" are often used interchangeably, and different countries use different terminology for the same type of document. A divorce decree is the court's formal order ending the marriage. A divorce certificate is a summary document issued by a civil registry confirming the divorce took place. USCIS accepts both. MEJPBS translates and certifies both — the document name does not affect the translation or certification process. If you are unsure which you have, email a scan and we will confirm.
A clear, high-quality scan or photograph of the divorce decree is sufficient for translation. You do not need to mail the original. Email your scan to info@mejpbs.com and we can begin immediately. The completed certified translation is shipped to any U.S. address or provided digitally.
Yes. MEJPBS translates divorce decrees from all Spanish-speaking countries — Mexico, Dominican Republic, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Cuba, Peru, Venezuela, and others. Email a scan to info@mejpbs.com and we can typically begin same day.
Yes. MEJPBS translates divorce decrees from all Arabic-speaking countries — Egypt, Morocco, Jordan, Algeria, Lebanon, Yemen, Palestine, Saudi Arabia, UAE, and others. Arabic divorce decrees may include court stamps, handwritten entries, and religious court documents (Sharia court decrees) — all of which we translate and certify.
